The Verbal Dude (operated by GD Test Prep E.I.R.L) provides:

• Online TOEFL® iBT 2026 test preparation courses and materials
• AI-powered evaluation tools (VerbalSpeakAI and VerbalWriteAI)
• Practice tests, exercises, and learning resources via our Moodle platform
• Private tutoring services (upon request)
• Free educational resources and guides

3. User Accounts and Registration

Free Trial: Users may register for a free trial to access limited course materials.

Paid Subscription: Full access to all courses, AI tools, and features requires a paid subscription.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Accurate Information: You agree to provide accurate and complete information during registration.

4. Payment Terms

Pricing: Course pricing is displayed on our website and is subject to change with notice.

Payment Processing: All payments are processed securely through our payment provider.

Refunds: Refund requests must be submitted within 7 days of purchase. Refunds are granted at our discretion and subject to evaluation of course usage.

No Refunds After 7 Days: After 7 days, all sales are final.

5. Intellectual Property

All content on The Verbal Dude website and learning platform, including but not limited to:

• Course materials, videos, exercises, and practice tests
• AI evaluation tools and algorithms
• Text, graphics, logos, and images
• Software and platform code

...are owned by GD Test Prep E.I.R.L or licensed to us and are protected by copyright, trademark, and intellectual property laws.

You may not:

• Copy, reproduce, distribute, or share course materials without written permission
• Record, screenshot, or download content for redistribution
• Use our materials for commercial purposes
• Reverse-engineer our AI tools or software

6. User Conduct

You agree not to:

• Share your account credentials with others
• Use the platform for any unlawful purpose
• Interfere with or disrupt our services or servers
• Attempt to gain unauthorized access to any part of our platform
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users or instructors

7. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• No Guarantee of Scores: We do not guarantee specific TOEFL® scores or test results
• Accuracy of Content: While we strive for accuracy, we do not warrant that all content is error-free or up-to-date
• Service Availability: We do not guarantee uninterrupted or error-free access to our platform

8. Limitation of Liability

To the maximum extent permitted by law, GD Test Prep E.I.R.L and The Verbal Dude shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from test scores, university admissions, or career outcomes
• Technical failures, platform downtime, or data loss

Our total liability shall not exceed the amount you paid for our services in the 12 months preceding the claim.

9. Third-Party Services

Our platform may contain links to third-party websites or services (e.g., Google Cloud, Moodle, payment processors). We are not responsible for the content, privacy practices, or terms of these third parties.

10. Modifications to Services and Terms

We reserve the right to:

• Modify, suspend, or discontinue any part of our services at any time
• Update these Terms and Conditions with notice
• Change pricing with advance notice to existing subscribers

Continued use of our services after changes constitutes acceptance of the new terms.

11. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms and Conditions
• Engage in fraudulent or abusive behavior
• Fail to pay subscription fees

Upon termination, you will lose access to all course materials and your account data may be deleted.

TOEFL® is a registered trademark of Educational Testing Service (ETS). The Verbal Dude is not affiliated with, endorsed by, or connected to ETS. Our courses are independent test preparation materials.

13. Governing Law and Disputes

Governing Law: These Terms are governed by the laws of Peru, where GD Test Prep E.I.R.L is registered.

Dispute Resolution: Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes may be submitted to arbitration in Lima, Peru.
